Terms of Use

These Terms of Use ("Terms") govern your use of the Hewett Health mobile application ("the App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1The service

Hewett Health is a personal fitness and nutrition tracking application that provides workout logging, nutrition tracking, sleep and fasting tracking, activity tracking, wellness scores, and AI-assisted features. The App is intended for general health and fitness purposes only.

2Eligibility

You must be at least 16 years old, or the age of digital consent in your country, to use the App. By using the App you confirm that you meet this requirement.

4Subscriptions and billing

The App offers an optional premium subscription ("Hewett Health Pro") which unlocks additional AI-powered features. The following terms apply:

• Subscriptions are offered on a monthly or annual basis and include a 7-day free trial for new subscribers.
• Payment is charged to your Apple App Store or Google Play account at confirmation of purchase, or at the end of the free trial period if you do not cancel beforehand.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time through your App Store or Google Play account settings. Cancelling stops future renewals but does not refund the current period.
• Any unused portion of a free trial is forfeited when you purchase a subscription.

All billing is handled securely by Apple or Google. Hewett Health does not collect or store your payment details.

5Acceptable use

You agree not to misuse the App, including by attempting to access it through unauthorised means, interfering with its normal operation, reverse-engineering it, or using it for any unlawful purpose.

6AI-generated content

Some features generate content using artificial intelligence. While we aim for accuracy, AI-generated workouts, meal plans, nutritional estimates, and insights may contain errors and should be reviewed with common sense and, where appropriate, professional guidance. You are responsible for how you act on AI-generated content.

7Your data

Your use of the App is also governed by our Privacy Policy, which explains how your information is handled. Most of your data is stored locally on your device, and you are responsible for maintaining your own device and backups.

8Intellectual property

The App, including its design, branding, and content (excluding your own logged data), is owned by Hewett Health and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.

9Limitation of liability

To the fullest extent permitted by law, Hewett Health shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the App. The App is provided "as is" without warranties of any kind, express or implied.

10Changes to the App and these Terms

We may update, modify, or discontinue features of the App at any time. We may also revise these Terms from time to time; significant changes will be reflected on this page with an updated date. Continued use of the App after changes constitutes acceptance of the revised Terms.

11Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
